Texas Lawmakers Are Working to Shield Polluters

Tell Your Representative: Protect the Rights of Texans to Contest Pollution Permits

Once again, the Texas Legislature is putting polluters before the people. House Bill 1865 would make it more difficult for Texans to challenge pollution permits that could harm their health and safety.

Texas law includes a process for challenging permits through contested case hearings. This process is overseen by an administrative law judge and requires permit applicants to prove that their proposed activities will comply with all federal and state legal and technical requirements to protect human health and safety, the environment and physical property. HB 1865 would flip that standard and force affected residents to prove that a proposed activity would cause harm.

This bill also would place an arbitrary time limit on all contested case hearings. This would force judges to rush what can be a very complicated process.

The Texas House of Representative will vote on HB 1865 in the next few days.
