HB 1794 Would Cap Penalties for Environmental Violations
House Bill 1794 by Representative Charlie Geren is a blatant attempt to protect polluters from the civil justice system. It would set an arbitrary cap of $4.3 million dollars for civil penalties assessed by a local government for an environmental violation.
Serious violations, which aren’t nearly as uncommon as they should be, can easily cause damages that exceed $4.3 million. If the companies responsible for the pollution they cause aren’t held responsible, local taxpayers and families will be left in the lurch. Families with medical costs from diseases like cancer will be stuck with expensive bills. Counties and cities will be left to deal with polluted land and water.
HB 1794 will likely be up for a vote on the House floor this Monday, April 27.
